1. Acceptance of Terms

By accessing and using Briefly Recruiting's CV builder services, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Briefly provides an AI-powered CV builder that analyzes uploaded CVs and job descriptions to generate polished, tailored CVs and cover letters. The service is provided "as is" and we reserve the right to modify or discontinue features at any time.

3. User Accounts and Registration

You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. Users must be at least 16 years old to use the service.

4. Subscription Tiers and Pricing

Briefly may offer multiple subscription tiers with different usage limits and features as detailed on our pricing page. Pricing is displayed in your local currency (EUR, GBP, or USD) for convenience, but all invoices are issued in EUR (€). We reserve the right to modify pricing with 30 days' notice to existing subscribers.

8. Data Privacy and Security

We are committed to protecting your personal data in accordance with GDPR (EU 2016/679) and German data protection law (BDSG-neu). Payment processing is handled securely by Stripe, and we do not store your credit card details. Stripe collects payment information including cardholder name, billing address, and email address necessary for transaction processing and fraud prevention. Please refer to our Data Security & Privacy page for detailed information about how we collect, process, store, and protect your data. By using our service, you consent to our data practices as described in our privacy documentation.

9. Acceptable Use Policy

You agree not to use the service to:

• Upload malicious files, viruses, or harmful code
• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Attempt to gain unauthorized access to our systems
• Use the service for any fraudulent or illegal purpose

10. AI-Generated Content Disclaimer

Our service uses artificial intelligence to analyze documents and generate CV and cover-letter content. While we strive for accuracy, AI-generated content may contain errors, biases, or inaccuracies. Generated content should be used as guidance only and not as the sole basis for employment decisions. Users are responsible for verifying the accuracy of information and using professional judgment.

11. Intellectual Property

All content, features, and functionality of the Briefly service, including but not limited to text, graphics, logos, and software, are the property of Briefly and are protected by international copyright, trademark, and other intellectual property laws. The CVs and documents generated by our AI remain your property, but you grant us a license to process your uploaded content to provide the service.

12. Limitation of Liability

To the maximum extent permitted by law, Briefly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim. Briefly is not liable for any issues arising from Stripe payment processing, though we will assist in resolving payment disputes where possible.

13. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms, non-payment, or any other reason at our discretion. Non-payment of subscription fees may result in immediate suspension of account access. You may terminate your account at any time through your account settings. Upon account deletion, your Stripe subscription (if any) will be automatically canceled. Your right to use the service will immediately cease, and we may delete your data in accordance with our retention policies.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the service. Continued use of the service after changes constitutes acceptance of the modified terms. We recommend reviewing these terms periodically. Changes to pricing or subscription terms will be communicated with at least 30 days' notice.

15. Governing Law and Jurisdiction

These terms shall be governed by and construed in accordance with the laws of Germany. Any disputes arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts in Hattingen, Germany. For payment-related disputes, you may also contact Stripe support directly through your Stripe Customer Portal.
